What if a child is involved in a do it yourself divorce?
Passion asked:
Plus what if the father is not around and I don't know where he's at, I heard if the child is a certain age he can say who he wants to live with, is this true? P.S. Thank you all for your first response, they were all helpful.

It depends on where you live. I know in California if the kid is under the age of 18 they do not have a say on who they live with. It is up to the court to decide who the better parent is. He surely isn’t since he abandoned the both of you. How are you going to serve papers to him if you do not know where he is?

Depends on the State you live in.. They also have some abandonment laws… in my state its 1 year of no attempt at contact and they loose al perental rights. I would talk to an attorny they can help you and most will talk to you for free. If not seek a legal aid or maybe a law Student for advice
