Car title in divorce settlement question?

My ex and I split almost 3 years ago.. and I was awarded the SUV in the divorce settlement. Since then, I have been paying monthly on it.. with the loan being in his name.. it will be paid off next June. My ex still has not gone to the DMV and transferred the title to me.. I keep asking him to, and he keeps ignoring it. I don't want to pay off the car with the title still in his name. Do I go to a lawyer? What will the law be in this case?

call the dmv you should be able to transfer the title using your divorce papers with out him present. If not try contacting the judges office who signed the divorce papers and let them know that he has not complied. and should let you know your options and he could be found in contempt

Call your loan company and advise them of the divorce settlement. The title can only be changed once the car is PAID and the title is actually received. (only the registered owner can be changed at the DMV) However, the loan company needs to be advised that you will be the owner of the vehicle, and that upon final payment the title needs to be mailed to your address not your ex’s.

If you want to be listed as the registered owner however, take your court papers to your local DMV and see what they can do for you.

You will probably need to provide written notice to the loan company.

Depends on what state you’re in but definitely call the office of the judge who awarded it to you. If the judge decided that car is yours he LEGALLY has to sign over that title. Usually the judge will make him sign it over to you in the chambers which is weird that you’re in this predicament anyway…. but get that ball a rolling.

you’re going to need to talk to a lawyer if it was stated in the divorce decree that the car was awarded to you. if he refuses, then he’s going against a COURT ORDER, and you need to take his butt back to court. Talk to the lawyer first, then politely ask mr. knucklehead to transfer the title. If he refuses, inform him that he’ll need an attorney since he’s violating the divorce decree. If he still doesn’t budge, stick to your guns!! you’re paying for this vehicle and I assume you have proof that YOU”VE made the payments since the divorce and not him, and he won’t have a leg to stand on. Why is it that you’ve waited until NOW to do this?!?! Why didn’t you do this when the divorce was finalized? Sometimes, playing nice only gets you into a bigger jam, than if you’d only insist the orders were carried out in a timely manner. good luck.

You said you were rewarded it in a divorce settlement.. I can completely understand why he wouldn’t sign the title over until it is completely 100% paid off for his credit.
