I am a house wife that has been married for almost 5 years. I`m considering a divorce due to uncontrollable family trouble and disagreement. I was a student and never had a career since I got married so I need to make sure I will have some financial stragedy if I get a divorce. Someone told me the wife is entitled to get 50% of earning during the marriage no matter what. How does this case work in the state of Calfonia? We have no children but he has his own 3kids from the previous marriages

First of all, they are his children and you will not get the children or child support. It’s up to the courts to decide ” IF ” and ” HOW MUCH ” you may be entitled to depending on your own personal contribution in the marriage. Unless the Dad is a complete screw-up, there’s no chance of you getting the children or child support from him.

he can probably file for uncontested divorce if he beats the 5 year deadline
and thus you get no support

but this assumes no children ( with you )
no assets ( house )
and less than 5 years of marriage
